The privacy of your personal data/information is important to The Northern Miner Group (“TNMG”). The Northern Miner Group is owned by EarthLabs Media Inc., a division of EarthLabs Incorporated Company, L.L.C. This notice (the “Policy”) describes The Northern Miner Group’s privacy and cookie usage policy as it pertains to the following websites (“Websites”, or individually a “Website”):

Collection

TNMG may ask for and collect from users personally identifiable and other information at certain intervals throughout their access to and use of one or more of our products, services and Websites. Depending on the information and/or the product or services users request, users may be asked to provide their name, email address, company, position, title and other information that is relevant to the information and/or products or services they have requested. In addition to the information users provide to us directly, TNMG and its service providers, such as, but not limited to, Google Inc., Salesforce and Pardot, also collect the domain names and IP addresses of its visitors, along with usage statistics and browsing history, including web pages visited, web forms completed and reports requested and downloaded. Data collected is used to more efficiently operate TNMG’s business, promote product and services, and administer our Websites. TNMG may combine this personally identifiable data and additional data with other information it collects. TNMG may also collect any information users choose to provide in your communications with us. Users should not send us personally identifiable information or complete any web forms containing personally identifiable information that they do not wish us to receive and process.

Unless the purposes for collecting personal information are obvious and the user voluntarily provides their personal information for those purposes, TNMG will communicate the purposes for which personal information is being collected, either orally or in writing, before or at the time of collection.

TNMG processes personal information for certain business purposes, in keeping with its legitimate interests for processing user personal data/information and those of its stakeholders, namely customers, prospects, readers, advertisers and sponsors. Business purposes include, but are not limited to, some or all of the following:

  • To verify identity and prevent fraudulent use of our platforms, products, and services
  • To process and respond to inquiries, and provide informational services
  • To identify user preferences and needs
  • To open and manage an account or subscription
  • To deliver requested products and services
  • To process a purchase transaction
  • To enhance, modify, personalize or otherwise improve our services and communications for the benefit of our users and website visitors
  • To send out information about TNMG’s products and services
  • To ensure a high standard of service to our users
  • To meet regulatory and legal requirements
  • To enhance the security and performance of our network and information systems
  • To enforce the Terms and Conditions of the respective websites.

Retention

If user personal information is used to make a decision that directly affects the user, TNMG will retain that personal information for at least one year so that the user has a reasonable opportunity to request access to it.

TNMG will retain user personal information only as long as necessary to fulfill the identified purposes or a legal or business purpose.

Accuracy

TNMG will make reasonable efforts to ensure that user personal information is accurate and complete where it may be used to make a decision about the user or disclosed to another organization.

Users may request correction to their personal information in order to ensure its accuracy and completeness. To update personal information, users may make a request in writing by providing sufficient detail to identify the personal information and the correction being sought. Requests for modification to personal information can be sent in writing to support@northernminer.com.

If the personal information is demonstrated to be inaccurate or incomplete, TNMG will correct the information as required and send the corrected information to any organization to which we disclosed the personal information in the previous year. If the correction is not made, TNMG will note the users’ correction request in the file. TNMG may require proof to support the request for modification (e.g. identification, proof of address, credit card or bank account such as in the case of refunds).

Public Information

In the event of a user voluntarily providing their personal information to be shown in the public domain on a TNMG owned Website or any of its affiliated Websites, the user will have the ability control, modify or remove their public information at their discretion. Users can contact support@northernminer.com for assistance related to their information being displayed on TNMG Website.

Information Sharing

TNMG may disclose your personally identifiable information in confidence to another entity (i) for purposes of outsourcing one or more of the operational aspects of its business; (ii) to confirm or update information provided by the user; (iii) to inform users of events, information about products and/or services, and other important information, and (iv) for other purposes disclosed at or before the time the information is collected on relevant web pages and forms. TNMG will also share your information when legally required to do so. In some cases, a user subscription may be owned by an employer or by another entity that has purchased it on behalf of the primary user; TNMG reserves the right to share information about the usage of a subscription with the party that paid for it.

Commercial Electronic Messages

In compliance with Canada’s Anti-Spam Legislation (CASL) and the EU’s General Data Protection Regulation (GDPR), TNMG communicates with users by means of commercial electronic messages (email, voicemail, via our various social media, etc.) to provide users with the products and/or services they have requested, whether as an individual or as a business person acting on behalf of a corporate entity. TNMG needs user permission to communicate information about a paid or free account, registration, products, services and events offered by TNMG. In addition to these emails, TNMG offers a number of standalone, free publications to which users may subscribe or unsubscribe at any time by clicking on the link at the bottom of the e-mail.

By agreeing to this Policy and TNMG’s Terms and Conditions, the user agrees to receive electronic communications from TNMG and its affiliated brands. Personal Information Protection

TNMG is committed to providing our users (subscribers, enrollees, registrants, clients, members, and readers) with exceptional service. As providing this service involves the collection, use and disclosure of some personal information about our users, protecting their personal information is one of our highest priorities.

TNMG commits to protecting personal information in accordance with both Ontario’s Freedom of Information and Protection of Privacy Act (FIPPA), and the EU’s General Data Protection Regulation (GDPR). FIPPA, the current revision, which came into effect on December 4, 2023, and sets out the ground rules for how Ontario businesses and not-for-profit organizations may collect, use and disclose personal information. GDPR, which came into effect May 25th, 2018, serves to protect the privacy and use of personally identifiable information of EU data subjects specifically. TNMG seeks to apply the most protective and otherwise beneficial privacy policies to all of its users.

Security

To protect from unauthorized access, collection, use, disclosure, copying, modification or disposal or similar risks, TNMG has implemented reasonable administrative, technical and physical security measures to protect user personal information. These measures may include, but are not limited to:

  • Encryption, firewalls and other digital measures
  • Restricting employee access to personal information as appropriate
  • Use appropriate security measures when destroying a user’s personal information such as shredding documents, deleting electronically stored information

Consent

TNMG will obtain user consent to collect, use or disclose personal information (except where, as noted below, we are authorized to do so without consent).

Consent can be provided orally, in writing, electronically, through an authorized representative or it can be implied where the purpose for collecting using or disclosing the personal information would be considered obvious and the user voluntarily provides personal information for that purpose.

Consent may also be implied where a user is given notice and an opportunity to opt-out of their personal information being used for mail-outs, the marketing of new products or services and the user does not opt-out in accordance with the Canadian Anti-Spam Legislation (CASL) of July 1, 2014, and the General Data Protection Regulation (GDPR) of May 25, 2018.

Subject to certain exceptions (e.g., the personal information is necessary to provide the product or service, or the withdrawal of consent would frustrate the performance of a legal obligation), users can withhold or withdraw their consent for TNMG to use their personal information in certain ways. A user’s decision to withhold or withdraw their consent to certain uses of personal information may restrict TNMG’s ability to provide a particular product or service. If so, TNMG will explain the situation to assist the user in making the decision.

TNMG may collect, use or disclose personal information without the client’s knowledge or consent in the following limited circumstances:

  • When the collection, use or disclosure of personal information is permitted or required by law or when TNMG requires legal advice from a lawyer
  • In an emergency that threatens an individual’s life, health, or personal security
  • When the personal information is available from a public source (e.g., a telephone directory or web site)
  • For the purposes of collecting a debt
  • To protect ourselves from fraud
  • To investigate an anticipated breach of an agreement or a contravention of law
  • TNMG will not sell client lists or personal information to other parties unless we have consent to do so.

Access

Users have a right to access their personal information, subject to limited exceptions as found in FIPPA and GDPR, including items such as solicitor-client privilege, disclosure that would reveal personal information about another individual, health and safety concerns, etc.

To access personal information users may make a request in writing by providing sufficient detail to identify the personal information being sought to the Data Privacy Officer at support@northernminer.com.

Upon request, TNMG will also tell users how their personal information and to whom it has been disclosed, if applicable.

A minimal and reasonable fee may be charged for providing access to personal information in certain circumstances in accordance with FIPPA and GDPR regulations. Where a fee may apply, TNMG will inform the user of the cost and request further direction from the user on whether or not to proceed with the request.

If a request is refused in full or in part, TNMG will notify the user in writing, providing the reasons for refusal and the recourse available to the user.

Links to Other Sites

TNMG Websites may contain links to advertiser and other third-party websites that TNMG does not own or control. TNMG is not responsible for the privacy practices or the content of such websites and does not endorse, control or make any representations, warranties or conditions concerning their contents or links. Once users have left a TNMG Website, TNMG cannot safeguard and is not responsible for the protection and privacy of any personal information/personal data that users provide on other websites. Users should review the applicable terms of use and privacy policies for those other websites.

Cookies

Cookies are small pieces of data that web pages place in computers to assist in returning to that page. TNMG uses cookies, pixel tags and other digital markers to track activities on our websites to help us identify what mining-related products and services users are interested in, so that we may continually work towards providing useful and relevant content. TNMG uses cookies to keep users authenticated on our websites so that users are required to sign in less frequently.

Our Websites use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help analyze how users use the Websites. The information generated by the cookie about your use of the Websites (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Websites, compiling reports on Website activity for Website operators and providing other services relating to Website activity and internet usage.

TNMG takes its cookies policy seriously, recognizing that cookies can be interpreted as personally identifiable information under privacy regulations such as FIPPA and GDPR. While we strictly use cookies only to service our users based upon their personal selections, we encourage all users to familiarize themselves with their browser’s cookie settings.
